WHAT IS AN UNDERWRITING AGENCY?
An underwriting Agency it’s an entity to which an insurance company delegates certain powers. This larger insurance company delegates part of its insurance capacity to the Underwriting Agency in order to issue insurance contracts, supplements, amendments, endorsements as well as managing the risks and the possible claims that may arise. All falling within the terms and conditions previously established by both parties.
ADMINISTRATIVE AUTHORITY
An Underwriting Agency falls within the law 26/2006 from the 17th of July established by Insurance Mediation and Private Reinsurance.( la Ley 26/2006 de 17 de Julio de Mediación de Seguros y Reaseguros Privados en su Disposición adicional tercera). The Underwriting Agencies that wishes to underwrite insurance risks within Spain must communicate these to the DGS. (The regulatory body) before commencement of their activity. The insurance company who grants the authority to the Underwriting Agency allows binding insurance and amendments thereto for the Underwriters´ Account, however only for those class(es) and for the coverage(s) stated in the schedule of agreement. The Underwriting Agency must communicate when such agreement ends.
